Welcome to The Reshaped Leader. These Terms of Use ("Terms") govern your access to and use of the website located at https://thereshapedleader.com (the "Site"), which is operated by The Reshaped Leader, operated by Dr. Joshua M. Brown ("we," "us," "our," or "the business"). The Site provides information about the non-clinical executive, leadership, relationship, and family coaching, consulting, speaking, and training services of Dr. Joshua M. Brown, Ph.D., M.S., and about the podcast "The Slow Drift." By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of These Terms

By accessing, browsing, or otherwise using the Site, or by submitting information through the contact form, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. These Terms constitute a legally binding agreement between you and the business. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Who May Use the Site

The Site is intended for a general adult audience in the United States. You must be at least 18 years of age to use the Site or to submit information through it. The Site is not directed to children, and we do not knowingly collect personal information from anyone under 13 years of age. If you are under 18, please do not use the Site or submit any information to us.

3. Description of Services

The business offers non-clinical services, which may include executive and leadership coaching, leadership consulting, speaking, training, and relationship and family coaching. The Site also promotes a podcast titled "The Slow Drift." The Site itself is an informational and marketing resource. It does not offer user accounts, online payments or checkout, e-commerce, appointment scheduling, or newsletter or marketing-email signup. Discovery calls and engagements are arranged by contacting the business directly.

4. Non-Clinical Nature of Services; No Professional Relationship

All services offered by the business are expressly non-clinical. They are coaching, consulting, speaking, and training services. They are not psychotherapy, counseling, psychological treatment, diagnosis, crisis intervention, or mental-health, medical, or clinical services of any kind. Dr. Brown is not accepting therapy or clinical clients through this practice or through the Site.

Nothing on the Site, and nothing arising from your use of the Site or your contact with the business, constitutes psychological, medical, mental-health, legal, financial, tax, or other professional advice. The content of the Site is provided for general informational purposes only and is not a substitute for advice from a qualified professional. You should not act or refrain from acting on the basis of any content on the Site without seeking appropriate professional advice tailored to your situation.

Using the Site, submitting the contact form, or otherwise contacting the business does not create a therapist-client, physician-patient, coaching, professional, contractual, or fiduciary relationship of any kind. A coaching or consulting relationship is formed only through a separate, mutual written agreement, and not through the Site.

5. No Guarantee of Results

Coaching, consulting, speaking, and training outcomes depend on many factors, including your own effort, circumstances, and participation. We do not guarantee any specific result or outcome. Individual results vary. Any statements on the Site regarding potential benefits are illustrative and are not promises or guarantees of any particular result.

All content on the Site — including but not limited to text, copy, graphics, logos and branding, images, design, and layout, together with the "The Reshaped Leader" and "The Slow Drift" names — is owned by or licensed to the business and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and use the Site for your own personal, non-commercial information. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the Site without our prior written permission, except as expressly permitted by these Terms or by applicable law.

9. User-Submitted Content Through the Contact Form

The Site provides a contact form that collects your name, email address, a topic or subject selection, and a free-text message. By submitting information through the contact form, you grant the business a limited, non-exclusive, royalty-free license to use, store, and process that information solely for the purpose of responding to your inquiry and communicating with you about the business's services.

Please do not submit any confidential, sensitive, or highly personal information through the contact form. In particular, do not send protected health information (PHI), medical or mental-health details, financial account information, government-identification numbers, or other sensitive personal data. The contact form is not a secure channel and is not intended for confidential or clinical communications. You are responsible for the accuracy and content of the information you submit, and you represent that you have the right to share any information you provide.

The Site may contain links to third-party websites, platforms, or services (for example, podcast hosting platforms) that are not owned or controlled by the business. We provide these links for convenience only. We do not endorse and are not responsible for the content, privacy practices, or availability of any third-party website or service. The Site is hosted on Wix and uses certain third-party service providers to operate, including Wix (hosting and content storage), Resend (delivery of contact-form notification emails), and Google Fonts (font delivery). Your use of any third-party website or service is subject to that third party's own terms and policies, and you access them at your own risk.

11. Disclaimer of Warranties

The Site and all content, information, and materials on it are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, the business disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties arising out of course of dealing or usage of trade. To the fullest extent permitted by applicable law, in no event will the business, or Dr. Joshua M. Brown, or any of its or his affiliates, agents, or service providers, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site or its content, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless the business, Dr. Joshua M. Brown, and its and his affiliates, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

14. Not for Emergencies; If You Are in Crisis

The Site and the business's services are not intended for emergencies or crisis situations. The business does not provide crisis intervention, emergency services, or mental-health care. If you are experiencing a medical or mental-health emergency, or if you or someone else may be in danger, call 911 immediately. If you are in emotional distress or crisis, or are having thoughts of suicide or self-harm, call or text 988 to reach the Suicide and Crisis Lifeline (available 24 hours a day, 7 days a week in the United States). Do not use the contact form to seek emergency help, as messages are not monitored in real time.

We may update or modify these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Any changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Nebraska, and you consent to the personal jurisdiction and venue of those courts.

17. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the business regarding your use of the Site and supersede any prior agreements or understandings on that subject. Our failure to enforce any provision of these Terms will not be considered a waiver of that provision.
